ENCASHMENT OF EARNED LEAVE IN OFB

OFFICE MEMORANDUM
Subject- Extension of the revised orders on encashment of Earned Leave and Half Pay Leave to industrial employees

The undersigned is directed to state that the matter regarding extension of revised orders on encashment of Earned Leave and Half Pay Leave to industrial employees at par with the non industrial Central Government employees covered by the CCS (Leave) Rules. 1972 has been under consideration of this Department. It has been decided in consultation with the Ministry of Finance (Department of Expenditure to extend the provision of this Department’s OM No. 1402813/2008- Estt.(L) dated 25th September 2008. mutatis mutandis to industrial employees of Ministries/ Department other than Railways. Accordingly industrial employees shall be entitled to encash both Earned Leave and Half Pay Leave, subject to overall limit of 300. Cash equivalent payable for Earned Leave shall continue unchanged. However, cash equivalent payable for Half Pay Leave shall be equal to leave salary admissible for Half Pay Leave plus Dearness Allowance admissible on the leave salary without any reduction being made on account of pension and pension equivalent of other retirement benefit payable To make up for the shortfall in Earned Leave, no commutation of Half Leave shall he allowed. This Department’s OM No. 14028/25/94_Estt.(L) dated 7th October 1996 stands amended to this extent.

2. These order shall take effect from the date of 07.11.2006. the date from which accumulation and encashment of 300 days EL were allowed to them and subject to the following conditions

i) The benefit will be admissible in respect of past cases i.e. relating to period      w.e.f. 07.11.2006 to till date, on receipt of applications to that effect from the pensioner concerned by the Administrative Ministry concerned

(ii) In respect of retirees (retired after 07.11.2006. who have already received encashment of earned leave of maximum limit of 300 days together with encashment of HPL standing at their credit on the date of retirement, such cases need not be reopened. However, such cases of Government servant considered as Industrial employees retiring after 07.11.2006, in which there was a shortfall in reaching the maximum limit of 300 days can be reopened.

Subject: Central Civil Services (Revised Pay) Rules, 2008 – the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.
The undersigned is directed to invite a reference to Rules 5 & 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.
2. This Ministry issued instructions vide this Departments OM No. 10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pie-revised pay scale as a onetime measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules 2008.
3. In view of the benefit extended to Central Government employees as per the aforesaid OM dated 19.3.2012, the issue relating to according of a fresh opportunity to Central Government employees to re-exercise their option to come over to the revised pay scale as per CCS(RP) Rules, 2008 was raised by the Staff side of the Joint Consultative Machinery in the meeting of the National Anomaly Committee held on 17.7.2012.
4 The matter has been considered by the Government and having regard to the fact that the provisions of the aforesaid OM dated 19.3.2012 bring about a material change in the basis for exercise of option to come over to the revised pay structure in terms of the CCS(RP) Rules, 2008 in respect of employees who are covered under the said OM dated 19.3.2012, the President is pleased to decide that all those employees who are covered under the provisions of the aforesaid OM dated 19.3.2012 may once again be permitted to re-exercise their option to come over to the Revised pay structure.
5. The benefit under these orders for re-exercise of option shall be available for a period up to 31.3.2013. The revised option shall be intimated to the head of the office by the concerned Government employees in accordance with the provision of Rule 6 (2) of the CCS (RP) rules, 2008.
6. All the Ministries and Departments are requested to bring the content of this OM to the notice of their employees so that such employees can avail themselves of the same within the stipulated time period.
7. In so far as persons serving in the Indian Audd and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.

INTERNATIONAL WOMEN DAY

INTERNATIONAL WOMEN DAY
International Women Day was celebrated on behalf of Indian National Defence Workers Federation on 8th March 2013 at HVF National Workers Union office at HVF Estate Avadi.  Women around 120 participated in the function.  The celebration was addresed by Advocate RAMAPRIYA GOPALAKRISHNAN on the women empowerment and the problems faced by the Working Women employees, Advocate also suggested ways and means to overcome the problem.  She urged the women employees to take up responsibility in the unions.  Shri Shylendranath AGM/HVF also participated and congratulated the women on the International Women Day and also appreciated INDWF for conducting such programmes where none has done and always leads in the forefront.
 









Shri R.SRINIVASAN, General Secretary guided the women on the challenges ahead,  He also on the occasion has raised the point for 15 minutes grace time for the Working Women employees of Ordnance Factories while mustering out.  The International Women Days have been celebrated by INDWF for the past several years

CORRELATION OF PIECE WORK PROFIT

Dear Colleagues,

13th STEERING COMMITTEE (11TH TERM) MEETING OF JCM IIILEVEL COUNCIL OF OFB HELD ON 27.02.2013 AT OFB HQRS, KOLKATTA UNDER THE CHAIRMANSHIP OF DDG/IR. MEMBER/PERS ALSO PARTICIPATED FOR SOME TIME TO HEAR THE VIEWS OF THE STAFF SIDE MMEMBERS.

Prior to this meeting, Member/Pers, OFB convened a meeting to discuss the co-relation piece work on revised pay of 6th CPC in continuation of the earlier meeting held on 12.12.12.  In the last meeting three Federations have strongly objected to any reduction in the job rate/Estimates on account of Co-relation in every pay commission.
            No conclusion could be arrived taking our views Member/Pers discussed with DGOF & Chairman and then convened this meeting with Federation leaders.

OFFICIAL SIDE PROPOSED THE FOLLOWING PROPOSALS

PROPOSAL – I         Rs.5200/- PB-I will be the basic pay for SSK, SK, HS II, HS I and MCM without any reduction.  This minimum of pay Rs.5200/- will be correlated irrespective of the job and skill.
PROPOSAL II          Rs.5200/- PB-1 will be co-related to SSK, SK to HSII & I and for MCM Rs.9300 will be co-related as minimum pay but 70% to 80% will be reduced in the earnings.
            The above two proposals were totally disagreed by the Federations and submitted the following proposals

PROPOSAL-I            Semiskilled is going to be abolished.  Therefore, Skilled Grade PB-I Rs.5200+1900 GP = Rs7100/- should be fixed as Basic Pay for all the grades upto HIS                           and
for MCM Rs.9300/- should be co-related for piece work without any reduction in Rates/Estimates
In addition, annual movements and allowances should be paid as separate elements without linking to piece work.
Further 3 ¼ hours between 44 ¾ and 48 Hrs in a week, piece workers should be paid OT Allowance on Time Wages at par with Day Workers.

After prolonged deliberations, to contain the cash out go, the following proposal was mutually agreed subject to the approval of DGOF & Chairman in consultation of Finance division/OFB and will be forwarded to     M of D
For Skilled, HS Grd-II          Rs.5200 will be taken as minimum of pay for calculating Hourly rate and HS Grd –I                       for all the correlated piece work
For MCM                              Rs.9300/- will be taken as minimum of pay for calculating the Hourly rate.
 The Demand of payment of OT for 3 ¼ hours to Piece workers has to be paid for which a separate case will be submitted to Government of Indian, Ministry of Defence. This has to be approved by Defence Finance, DOP&T, Ministry of Defence.  This has to be approved by Defence Finance, DOP&T, Ministry of Finance and finally cabinet has to approve for issue of final orders.
To reach a Settlement it was unanimously agreed that there will be no reduction in rates/Estimates.
