CORRELATION OF PIECE WORK PROFIT

INDWF/Circular/2013                                                                                                04.03.2013

Dear Colleagues,

13th STEERING COMMITTEE (11TH TERM) MEETING OF JCM IIILEVEL COUNCIL OF OFB HELD ON 27.02.2013 AT OFB HQRS, KOLKATTA UNDER THE CHAIRMANSHIP OF DDG/IR. MEMBER/PERS ALSO PARTICIPATED FOR SOME TIME TO HEAR THE VIEWS OF THE STAFF SIDE MMEMBERS.

Prior to this meeting, Member/Pers, OFB convened a meeting to discuss the co-relation piece work on revised pay of 6th CPC in continuation of the earlier meeting held on 12.12.12.  In the last meeting three Federations have strongly objected to any reduction in the job rate/Estimates on account of Co-relation in every pay commission.
No conclusion could be arrived taking our views Member/Pers discussed with DGOF & Chairman and then convened this meeting with Federation leaders.

OFFICIAL SIDE PROPOSED THE FOLLOWING PROPOSALS

PROPOSAL – I         Rs.5200/- PB-I will be the basic pay for SSK, SK, HS II, HS I and MCM without any reduction.  This minimum of pay Rs.5200/- will be correlated irrespective of the job and skill.
PROPOSAL II          Rs.5200/- PB-1 will be co-related to SSK, SK to HSII & I and for MCM Rs.9300 will be co-related as minimum pay but 70% to 80% will be reduced in the earnings.
The above two proposals were totally disagreed by the Federations and submitted the following proposals

PROPOSAL-I            Semiskilled is going to be abolished.  Therefore, Skilled Grade PB-I Rs.5200+1900 GP = Rs7100/- should be fixed as Basic Pay for all the grades upto HIS                           and
for MCM Rs.9300/- should be co-related for piece work without any reduction in Rates/Estimates
In addition, annual movements and allowances should be paid as separate elements without linking to piece work.
Further 3 ¼ hours between 44 ¾ and 48 Hrs in a week, piece workers should be paid OT Allowance on Time Wages at par with Day Workers.

After prolonged deliberations, to contain the cash out go, the following proposal was mutually agreed subject to the approval of DGOF & Chairman in consultation of Finance division/OFB and will be forwarded to     M of D
For Skilled, HS Grd-II          Rs.5200 will be taken as minimum of pay for calculating Hourly rate and HS Grd –I                       for all the correlated piece work
For MCM                              Rs.9300/- will be taken as minimum of pay for calculating the Hourly rate.
The Demand of payment of OT for 3 ¼ hours to Piece workers has to be paid for which a separate case will be submitted to Government of Indian, Ministry of Defence. This has to be approved by Defence Finance, DOP&T, Ministry of Defence.  This has to be approved by Defence Finance, DOP&T, Ministry of Finance and finally cabinet has to approve for issue of final orders.
To reach a Settlement it was unanimously agreed that there will be no reduction in rates/Estimates.

Yours Sincerely,

(R.SRINIVASAN)
General Secretary.

INDWF/MACP/2013/3001                                                                            Date: 07.01.2013

To
The Secretary to Government of India,
Department of Personnel & Training,
New Delhi 110 011.

Sub: Granting of MACP-3 to Master craftsman holding the posts prior to
01.01.2006 and re-designation/Transfer to Chargeman (T) in Defence
            Ref: i) DOP&T letter ID No.7680/12/CR dt.13.07.2012 &
                        M of D ID No.11 (5)/2009-D (Civ-1) dt 23.07.2012
ii) Our representation to DOP&T letter No.INDWF/MACP/M of D/3001/2012
                        dt 22.11.2012 and 11.12.2012
Sir,
In continuation to our above reference letters cited above, we further wish to submit our representation on the above subject for your early and speedy actions to grant 3rd MACP to MCM and Chargeman transferred from MCM in the Defence Establishments.
MOD I.D.No.11 (1)/2002/D(Civ-I) dated 20.05.2003 states that:
“Highly Skilled Grade II and Highly Skilled Grade I have been merged w.e.f. 01.01.1996 and the grade structure of skilled and Highly Skilled Grade categories shall be in the ratio of 65:35 with 10% of Highly Skilled employees as Master Craftsman w.e.f. 01.01.1996 to 19.05.2003.
Para 3(b) of the MOD I.D. dated 20.05.2003 further states that “Master Craftsman shall not be part of the Hierarchy and the placement in this grade will not be treated as promotions for Highly skilled Grade either under normal promotion rules or under ACP Scheme”
Employees having MCM Grade prior to 01.01.2006 and MCM got transferred to Chargeman were considered for 3rd MACP and granted Rs.4,600/- Grade Pay.  Based on MOD I.D. dated 23.07.2012,   PC of A Fys, Kolkatta issued instructions vide their letter No.Pay/Tech-II/04/2012/20 dated 02.10.2012 to all CDA’s/Br. Accounts Office to implement the ibid M of D order dt.23.07.2012 allowing the Grade Pay of Rs.4,200/- instead of Rs.4,600/- to MCM’s who got 3rd MACP upgradation and resultant over payment if any may be recovered.  Based on that, the recovery on overpayment was proposed.  On the representation pending with DOP&T, it was agreed by PC of AFys, Kolkatta to maintain the STATUS QUO upto December 2012 due to which the recovery has been kept in abeyance for one month till December 2012.
In respect of the issue, we would like to request you to review your clarifications given to M of D vide your letter dt 13.07.2012.  The following points needs to be considered on the reasons given below in this regard
      i.          The post of Master craftsman does not find mention as feeder category in any of the SROs for Chargeman.  The Master Craftsman are being made Chargeman using the provisions of existing SRO 13(E) of 1989 in which HS is the feeder grade and Master Craftsman being part of Highly Skilled grade was eligible for promotion to Chargeman.
ii.          Therefore, consequent upon implementation of 4 grade structure in respect of Artisan Staff, MCM are being made Chargeman which happens to be in the same Grade pay of Rs.4200/- without giving them any benefits of pay fixation.  This movement of MCM to Chargeman cannot be construed as promotion in the same grade.
Reference is also invited to Clarification No.35 of DOP&T OM F.No.35035/1/97-Estt(D)/(Vol.IV) dated 18th July 2001, which is being reproduced below for ready reference
Sl.No.
Point of Doubt
Clarification
35
Whether placement/appointment in higher scales of pay based on the recommendation of the Pay Commissions or Committees set up to rationalise the cadre is to be reckoned as promotion/financial upgradation and offset against the two financial up gradations applicable under the ACP Scheme?
Where all the post are placed in a higher scale of pay, with or without a change in the designation, without requirement of any new qualification for holding the post in the higher grade, not specified in the Recruitment Rules for the existing post and without involving any change in responsibilities and duties, then placement of all the incumbents against such upgraded posts is not be treated as promotion/upgradation.
Thus the following become very evident from the above elucidations.
a.         The post of MCM was not post of hierarchy prior to 01.01.2006 and as such movement of an employee from Highly Skilled to Master Craftsman cannot be treated as promotions for any purpose, including ACP/MACP.
b.         As per DOP&T OM of 2001, it is clear that since all the posts of MCM as on 31.12.2005 were enbloc upgraded to Higher Pay Scale, the higher pay scale granted to MCM w.e.f.01.01.2006 cannot be treated as promotion.  Accordingly the MCM who are placed in the pre-revised pay scale of Rs.5000-8000 w.e.f. 01.01.2006 are entitled for their next ACP/MACP in PB 2 + Grade Pay Rs.4600/- by ignoring the higher pay scale granted to them w.e.f.01.01.2006
c.         The post of MCM, is part of hierarchy w.e.f. 01.01.2006 but not a feeder post to Chargeman, and as such any movement from MCM to Chargeman cannot be treated as a case of promotion in the same Grade pay.
A copy of PC of A(Fys) circular no.Pay/Tech-II dated 05.10.2012 is also being enclosed, wherein it has been clearly opined that in view of various Government communications on the subject of ACP/MACP, the post of Master craftsman should logically get 3rd MACP in the Grade Pay of Rs.4600/-.
In view of the facts as stated above, OFB has recommended that the post of  Master Craftsman should get 3rd MACP in the Grade Pay of Rs.4600/-.  It is therefore requested that the matter be viewed afresh by DOP&T in the light of above facts and get the matter resolved at an early date.
Since the recovery has been kept in abeyance by PC of A Fys, Kolkatta till December 2012, it is requested that an early decision in this regard is most important as many employees including retiring employees fixation of pension and granting of terminal benefits etc. In E-in-C’s Directorate, the Master Craftsman is not having any further promotion to next higher grade.
On the basis of the report in this respect submitted by Ordnance Factory Board to M of D and the same was submitted to DOP&T by M of D, an immediate action is required at the earliest for settling the matter by granting 3rd MACP to MCM and the MCM transferred to Chargeman(T) as it is not a feeder grade to Chargeman as per the provisions of the existing SRO.
An early action in this regard is expected at an early date.
Yours Sincerely,

(R.SRINIVASAN)

INDWF/PM/Budget/2013                                                                            19.01.2013
To
Hon’blePrime Minister,
Government of India,
New Delhi 110 011.

Sub: General Budget 2013 – INDWF proposals for General Budget 2013

Sir,
Indian National Defence Workers Federation affiliated to Indian National Trade Union Congress is the Federation of around 300 unions in the Defence Civilian Sector consisting of around more than 1 lac employees as its members
GENERAL BUDGET 2013 – Consideration of INDWF’s Proposals:
INDWF requests the Hon’ble Finance Minister to kindly consider the following proposals for inclusion in the General Budget 2013 which would provide relief to over 34 lac of Central Government Employees (including 3.5 lacs of Defence Civilian employee) and also other workers.
1.  Annual income amounting to Rs.5 lacs may be exempted from the purview of income tax in view of steep rise in prices of essential commodities.
2.  Since the percentage of Dearness Allowance has crossed 50% of pay long ago there is thus immediate need for setting up of VII Central Pay Commission, alternatively, the Government may consider setting up of Permanent Wage Revision Board.
3.  50% DA may be merged with pay as was done in the year 2004.
4.  Bonus Act to be amended for ensuring payment of Bonus including that of Productivity Linked Bonus (PLB) on actual monthly wages, alternatively, the limit may be enhanced to Rs.10, 000 for payment of PLB to Defence Civilian Employees.
5.  New Pension Scheme for the employees joined Government services after 01.01.2004 is anti-worker and anti-staff.  NPS does not carry safe guards admissible under the Pension Rules 1993; The New Pension Scheme needs to be scrapped.
6.  Additional pension be allowed to the retired Central Government employees on attaining 70 years of age.
7.  INDWF proposed upward revision of retirement age on superannuation from 60 to 62 years in the wake of mass retirements during the coming years, as it is possible that there may be shortage of skilled and qualified personnel.
8.  Thousands of contract workers have been engaged in the Public and Private Sector industries with a meager salary.  This way, the exploitation of poor labourers is going on unabatedly.  We are demanding abolition of contract labour system in all the industries, particularly the Government owned sectors.  Till such time a policy is framed, we propose that the same remuneration as that of permanent workers be paid to the contract workers as well as outsourced workers.
9.  The perks/fringe benefits presently being availed by the workers including private sector workers as incentive be considered for exemption from the taxes.
10.  Transport Allowance paid to the Central Government employees including Defence Employees may be exempted from the purview of income tax.
11.  Children Education Allowance being re-imbursed to all the employees for their school going children to the tune of Rs.15,000/- per child per year, but the same is being taxed, only a rebate of Rs.40 per annum. Hence, it is requested to exempt the Children Education Allowance from the purview of Income Tax to the full extent of the allowance paid to the employee.
12.  For adequate career growth of Teachers and Lecturers of Central Government Institutions particularly in Ordnance Factories, the Modified Assured Career Progression Scheme (MACP) may be made applicable to them.

INDWF is confident that the Hon’ble Finance Minister would give serious consideration to the above proposals for making Budget announcements.

Thanking you,
Yours Sincerely,
 (R.SRINIVASAN)
General Secretary.

SPEECH POINTS RAISED BY R.SRINIVASAN, SECRETARY STAFF SIDE, JCM III,OFB MEETING HELD ON 02.08.2012

SPEECH POINTS RAISED BY R.SRINIVASAN, SECRETARY STAFF SIDE, JCM III, OFB,MEETING HELD ON 02.08.2012
1. Extended Welcome to Chairman and DGOF, all members of OFB present and both official side and staff side for the meeting of JCM III level council.
He thanked DGOF and Chairman for giving lot more details about the organisations role in meeting the increased requirements of the Armed forces by raising the demand of Rs.46,000 crores in 11th Five Year Plan to Rs.92000crores which shows the 0econfidence on Ordnance Factories by M of D.  This is an encouraging trend in the present juncture as we have seen many downfalls and were facing tough situation having no sufficient load which led to diversification and taking load from outside.  We should strive hard and work together to raise the flag high by fulfilling the commitments and not giving chance to outside players to encroach into our field.  For which on behalf of INDWF and Staff side we assure our best co-operation.
The proposed welfare schemes proposed by Chairman such as annual cultural meet, Housing society, creating Hostel facility at Ambjahari and coaching centre at Kanpur are welcome.  This shows the concern of OFB on our employees, Staff and Officers.
To achieve the goals/Targets, OFB may come out with an Action Plan which can be discussed and jointly make it implimentable and achievable.
Expansion by adding new organisations with OFB will boost our activities by utilising the available infrastructure.
This Bipartite participation system should be strengthened and be utilised to its best so that the industrial Relation situation may be kept in better control.
2. HAPP Trichy though originally established to manufacture Tank Ammunition but now the factory is facing raw material problem i.e. Tungsten powder import due to which FSAPDS production is not taking place.  Import action may be expedited.  RGB-60 & 12 product was successfully established by HAPP to Navy.  Load is available but the existing capacity is very less.  PINAKA production is also added.  Therefore, the draft project report in this respect for augmentation may be cleared at the earliest by which Factory can get manpower, Machineries and additional buildings etc.
3. OF Trichy was manufacturing 5.56 Rifles which has now come to minimum requirement of only 10,000.  OFT has successfully established assault Rifles which is considered equivalent to AK47.  M of D is importing Assault Rifles.  Therefore, orders may be obtained for Assault Rifles projected to OFT in respect of                   30 mm Canon 105 nos, 12.7 only 15 nos this may be revised upward otherwise the Factory come to under utilisation.
4. At OF Muradhnagar Hand grenade last year load was 8.7 lakh and current year need to be produced 13 lakh nos. No supplies of orders at least immediately 5 lakh order may be given to utilised and engage the manpower.  It is understood OF Chanda is not having detonators to assemble and therefore orders/Demand was not given.  This may be noted and orders may be given.
5. 81 mm HE Bomb body forgings from OFAJ were to be supplied to OFM for machining.  Till date no order.  This may be expedited.
6. We are thankful that OFB considered and granted 1975 posts of Labourer SSK for Direct Recruitment in Ordnance Factories.  This is a welcome decision by this contract Labour engagement will reduce we should gradually do away in engaging contract labour in Ordnance Factories which is resulting in Theft, indiscipline and improper utilisation of this manpower.
7. With regard to IR situation in Ordnance Factories, earlier it was dealt by deputing Officers from OFB Personnel Division and Federation Leaders to settle the issues.  Now this is given less priority and few Factories are adopting unfair Labour practice leading to conflicts and unrest as well as victimising the Union leaders.  A Mechanism may be evolved to control and settle the Industrial Relation situation.
8. Piece work Co-relation on 6th CPC pay needs to be expedited by holding discussions at the Apex level between OFB and Federations mutually so that the proposal can be forwarded to M of D for early approval.  Priority may be given to this.
9. With regard to GSF, 4 Grade Structure in respect of IE’s has not been implemented yet on the reasons that the matter is sub-judice.  It is requested that the GSF management and OFB should take necessary steps to vacate the stay order for implementation.  Many employees are superannuating from service, the beneficiaries are loosing on an average Rs.2000 to Rs.3000 every month which is leading to frustration, kindly expedite.
10. Despite various clarifications sought by Factories and issued by OFB still many Factories are yet to implement and accord the financial benefit.  This may be monitored and the Action Taken Report may be obtained for the information of the Council.
11. There are many issues pertaining to Factories and OFB in respect of Personnel matters which are being raised frequently in all the meetings by the Staff side members and issues are pending unresolved.  It is therefore suggested to form small Working Groups to study and find out the actual reasons and suggest the remedial measures by which issues can be settled/closed and the time can be saved.  Also as it was proposed Audit in administration matters in respect of Promotions, Seniority, Reservation, Maintaining ratio in Promotion and Recruitment etc., can be maintained without any kind of manipulations. Etc.,
12. Centralised Seniority in respect of NIE’s & NGOs may be updated every year and be made available to the Factories.
13. Policy adopted in respect of Medical Officers now and the orders issued for transfers has created not only disturbance to them but also created vacuum in Hospitals particularly HVF Hospital where Surgeon, Anaesthesia and Gynaecologist and Two other medical officers are transferred.  This may be reviewed on their Children’s study, near retirement etc., and to avoid frustrations.
14. The issue of acute stagnation in the Store Keeping cadre may be considered as important and priority should be given to implement the proposal of AWATI Committee by diverting some posts of Chargeman (T) to relieve the stagnation of Storekeeping Cadre as an immediate measure.  Cadre Review Proposal is a long term relief and the immediate relief is most important.
15. JCM members and Federation Leaders are provided the accommodation at IB.  Due to renewal of IB, the Mayur Bhawan, HANS Bhawan was constructed. But at times we are denied accommodation when approached through OFB.  It is therefore, we request at least 4 Rooms in Mayur Bhawan may be kept under the Control of OFB to provide accommodation for JCM II, III and Federation Leaders when not occupied by these leaders, during that time Factory may utilise under the intimation to OFB.
16. Ordnance Factory Board may consider to introduce Job Guaranteed Training Schemes like Journeyman Ship Training, SCT, SAT training etc for future requirements and to impart better Training so that they will be better qualified for future Supervisory posts.
17. On LTC Home town, necessary clarification may be issued by PC of A Fys for converting to All India LTC.
18. JWMs working in Factories for a longer period say 20-30 years and also in one section may be rotated within the Factory or between the Factories to avoid monopoly.
19. OCF Chandigarh we received representation that many trees have been rooted out and the timber is piled/stocked at the Factory which is not with the approval of the Forest Department which may be enquired and corrective steps may be taken.
20. Employees of MCM grade were promoted to Chargemen(T) against their objection between 01.01.2006 and after, since MCM and Chargeman (T) are drawing identical Pay it is not a promotion, only Transfer.  But Factory is treating as Promotion and refusal of promotion is not entitled for MACP Rs.4, 600/- which may be settled by reverting to MCM grade.
21. In respect of DBW and CPW for DR in SSK the desirable qualification trade background etc., may be clearly notified including the Trade Test specification as number of candidates are not available in AOCP Trades.
22. Taking into account of the present workload, the sanctioned manpower may be revised in all Ordnance Factories, the sanction should not be more than the authorisation and sometimes authorisation is less than the sanction.  This may be revised.
23. Member representing in the APEX Productivity council (APC) should be considered as equal to JCM members and if they are serving employees, they should be given all facilities and representation alike JCM members in Factories.  Necessary instructions may be issued.
24. The norms decided by OFB for allowing candidates to appear in Limited Departmental Competitive Exams may be made clear for the information of the House and also necessary amendments be made in SRO.
25. Teachers strength may be increased in Factory schools as per demand and also the applicability of RTE Act in OF Schools may be clarified.
26. Employees deputed to various locations for attending Official Duties other than Ordnance Factories should be taken care of their Overtime, Incentive Loss.  A suitable decision is required to be taken to avoid financial loss to them.
27. New Pay slips may be introduced for wage disbursement of Industrial Employees for August to be paid in the month of September.
28. Cadre review of Chargeman and JWM, a committee under the Chairmanship of              Shri R.N.Ralegaonkar, AGM/OFAJ, to be constituted and the same to be undertaken
29. Direct Recruitment for the post of Chargeman for 829 posts has been sent to SSC.

31. MACP and PLB pending for Teaching staff is taken up with MoD.
32. Computer Classes to be arranged in Ordnance Factory Schools for the betterment of the Children studying in the Ordnance Factory Schools.
33. High level committee to be formed for Explosive Factories for discussion on Safety Points.

Cadre restructuring of Store Keeping Staff in Ordnance Factories Organisation

Sub: Cadre restructuring of Store Keeping Staff in Ordnance Factories Organisation.

After the implementation of the VIth CPC by the Govt. of India, there is a growing demand from staff side to review the Cadre of Store Keeping Staff in the Ordnance Factories Organisation.
